1. Acceptance of Terms

By creating an account and using ChapishaApp, you agree to be bound by these Terms of Service.

2. Service Description

ChapishaApp is an AI-powered SaaS tool designed to generate social media content. You are granted a limited, non-exclusive license to use the app for your personal or business social media management.

3. Points, Billing, and Subscriptions

• Points System: Content generation costs points (currently 5 points per generation). The free tier provides 50 points.
• Subscriptions: Paid plans (Basic and Pro) are billed monthly via Stripe.
• Cancellations: You may cancel your subscription at any time through the billing portal. You will retain access to your paid points until the end of your current billing cycle.

4. Content Ownership

You retain ownership of the original text prompts and images you upload. Biashara Softwares retains all intellectual property rights to the ChapishaApp platform, code, and template structures.

5. Rate Limiting and Fair Use

To ensure platform stability, we enforce rate limits (e.g., 5 checkout requests per minute per user). Automated scraping or attempting to bypass the point system will result in immediate account termination.

ChapishaApp, a product of Biashara Softwares, provides AI-powered content generation tools. To ensure a safe environment and maintain our integrations with third-party platforms (Google AI, Twitter, Instagram, LinkedIn, TikTok, and Facebook), you agree to adhere to this Acceptable Use Policy.

Prohibited Conduct

• Illegal or Harmful Content: You may not use ChapishaApp to generate content that promotes violence, illegal acts, self-harm, harassment, or discrimination.
• Spam & Platform Abuse: You may not use the platform to generate mass spam, automated bot networks, or content designed to manipulate the algorithms of connected social media networks.
• System Abuse: Attempting to bypass the point-based billing system, reverse-engineer the Next.js/Stripe payment architecture, or aggressively overload the generation endpoints (bypassing the 5 requests/minute limit) will result in an immediate, permanent ban without a refund.
• Misinformation: Generating deepfakes, synthetic media meant to deceive, or automated political disinformation is strictly prohibited.

Enforcement

Biashara Softwares reserves the right to suspend or terminate any account, revoke available points, and report severe violations to the respective authorities or API partners.

1. Digital Goods & API Costs

ChapishaApp provides access to digital services and utilizes third-party artificial intelligence APIs (Google Gemini) that incur hard costs for every generation. Because of this, all subscription payments and point purchases are strictly non-refundable once processed.

2. Subscription Cancellations

You are free to cancel your monthly subscription at any time using the Stripe Customer Portal accessible from your dashboard. If you cancel, you will not be billed for the following month, but we do not prorate or refund unused days or points in your current billing cycle.

3. Technical Faults

If a documented technical error on our end (e.g., complete system downtime) prevents you from using the points you purchased, please contact support within 7 days. Biashara Softwares may, at its sole discretion, issue a point credit to your account. We do not offer cash refunds.

The content generated by ChapishaApp is created using artificial intelligence. While we strive for high-quality outputs, AI can occasionally produce inaccurate, biased, or inappropriate content (“hallucinations”). ChapishaApp provides all generated content “as is.” You are solely responsible for reviewing, fact-checking, and editing all content before publishing it to any social media platform.

2. Third-Party Platform Compliance

ChapishaApp generates text formatted for platforms like Twitter, Instagram, LinkedIn, TikTok, and Facebook. We are not affiliated with these companies. It is your responsibility to ensure the content you generate and post complies with the respective Terms of Service of those third-party networks. Biashara Softwares is not liable if your social media account is penalized, shadow-banned, or suspended.

3. No Warranties

Biashara Softwares makes no warranties, expressed or implied, regarding the continuous availability of the app, the accuracy of the AI outputs, or the impact the generated content will have on your social media engagement or business revenue.
